Among daily used chemical products, “Household Chemical Products” containing chemical substances which are likely to be exposed to human and environment, shall be managed by “The Act on Safety Management of Consumer Chemical Products and Biocides” (Chemical Product Safety Act, K-BPR) and it will enact on Jan. 1st 2019 Anyone who imports or manufactures the “Household Chemical Products Subject to Safety Confirmation” shall comply with the safety and labeling standards.
Under the Chemical Product Safety Act, household chemical products are defined as below.
Household chemical products are the chemical products daily used in the living spaces such as homes, offices and public facilities. Since they are likely to cause chemical exposure to humans or the environment, safety confirmation is necessary. Household chemical products subject to safety confirmation are designated by the Minister of Environment as they are determined to have potential risk after having the risk assessment.
Household chemical products subject to safety confirmation are designated and classified into the following 35 types of product group. The biocidal products which are approved by the Minister of Environment shall be excluded from the household chemical products in accordance with Chemical Product Safety Act.
Type of household chemical products subject to safety confirmation
Anyone who intends to manufacture or import products of the above types shall obtain safety confirmation from the designated test /inspection institutions at interval of every 3 years.
Also, a person who intends to manufacture or import household chemical products subject to safety confirmation, of which the safety standards are not announced shall submit the data materials on the chemical substance contained in the product to obtain the approval of the MoE. Those products are as follows.
In addition, anyone who intends to sell or distribute household chemical products subject to safety confirmation, of which the safety is confirmed or approved on the market, shall comply with the labeling standards in labeling on the surface of the product.
If you fail to comply with the safety standards, you shall be penalized for imprisonment for up to 7 years or penalty of up to KRW 70 million or for both of imprisonment and penalty. In addition, you can receive an order to recall or dispose of the product, and the amount equivalent to the sales amount can be charged as a penalty.
